A Chapter 13 Bankruptcy is sometimes called a Wage-Earner Plan because a Chapter 13 Bankruptcy is open from 3 to 5 years and a Chapter 13 case requires a monthly payment to the Chapter 13 Bankruptcy Trustee.
Filing a chapter 13 bankruptcy automatically stops home foreclosures, vehicle repossessions, wage garnishments, and other collection actions. Chapter 13 is commonly used to reorganize non-dischargeable debts that must be repaid such as home mortgages, equity lines of credit, child support, vehicle payments, taxes, student loans, and traffic tickets. It may help a person whose Washington State drivers license has been suspended or revoked get their licenses reinstated.
You have the opportunity through the Chapter 13 Bankruptcy Plan to propose how your plan payments will be used. These plan payments can be used to bring mortgage or car payments current, or to pay delinquent taxes that may not be dischargeable, or to define payment of child support arrears or other special types of debts and accounts. A Chapter 13 bankruptcy may also make payments to general unsecured creditors. Some plans pay all general unsecured claims. Some plans pay nothing to general unsecured claims.
