Chapter 7 Bankruptcy

A Chapter 7 Bankruptcy is sometimes called a Fresh Start Bankruptcy.  It is a relatively quick process that takes about 100 days from filing to case closing.

We can usually have your case ready for review, signature and filing within a week or two after your bring your questionnaire and supporting documents to us.  In an emergency situation we may be able to file your case immediately.

We file your case shortly after you review and sign the documents.  You will not need to go to the court to get your case filed, we will handle the initial filing for you.

There is a hearing at the US Bankruptcy Court that occurs about 30 days after we file your case.  You will need to attend that hearing and an attorney from the firm will be there with you for the hearing. This hearing, known as a “341 hearing” or “creditors meeting” often takes only a few minutes.  We will help you file any additional documents or amendments that need to be submitted and you can expect to receive a discharge of debt about 60 to 70 days after the 341 hearing.

Some debts may not discharge through bankruptcy.  Student loans, tickets, criminal fines, child support, and a few other types of debt are not dischargeable through bankruptcy.  Credit card bills, medical bills and many types of general consumer debt are generally discharged through bankruptcy proceedings.

Bankruptcy filing includes a financial determination known as the “Means Test” that is used to determine if a person can qualify for a Chapter 7 Bankruptcy filing.  The Means Test may indicate that you will be required to file a Chapter 13 Wage Earner Bankruptcy instead of a Chapter 7 Fresh Start Bankruptcy that you may prefer.
